Terms of service

The agreement between you and us.

These terms govern your use of Film Gear Hub. They include a binding arbitration clause and a class action waiver in section 20, which affect how any dispute between us gets resolved. You can opt out of arbitration within 30 days and still use the service.

Effective 28 October 2026 · Last updated 28 October 2026

1

Who you are agreeing with

Film Gear Hub is operated by Film Gear Hub, LLC, a Texas limited liability company, of 5900 Balcones Drive, STE 100, Austin, TX 78731 (“we”, “us”). By creating an account or using the service you accept these terms. If you do not accept them, do not use the service.

You must be at least 18 and legally able to enter a contract. If you are using the service for a business, you confirm you can bind that business.

2

What this marketplace is, and what it is not

We are a venue. Members sell to members. We are not the seller of anything listed here. We do not own the goods, we never take possession of them, we do not inspect them, and we take no title to them at any point.

What we do is verify sellers, record serial numbers, hold the payment, buy the shipping label, and stand behind the Not-As-Described Guarantee in section 11. Those are real obligations and we mean them. They are not the same thing as being the merchant of record for the item.

We are not a bank, a broker, an auctioneer, a pawnbroker, an appraiser, or an insurer. Funds we hold are not deposits, are not FDIC insured, and earn no interest for you.

The 50 states and DC only, for now. Items must ship from an address in the 50 states or the District of Columbia to an address in the 50 states or the District of Columbia. We do not accept an address outside that, including US territories and military post office addresses, we do not buy international labels, and payment from a card issued outside the United States is held for review rather than shipped against. If you are outside the 50 states and DC, this is not a service you can use yet, and we would rather say so than take your money and find out at the label.

3

Your account

Give us accurate information and keep it current. One account per person. You are responsible for what happens under your account, and you must tell us promptly if you think someone else has access to it.

Selling requires passing a government ID check through Stripe Identity and linking a payout account in the same name. We may refuse, suspend or reverse verification if the check fails, if the names do not match, or if we have a reasonable basis to suspect fraud.

Payouts are made through Stripe. When you link a payout account you also agree to Stripe’s Connected Account Agreement, which sits alongside these terms for that account.

4

Listing rules

As a seller, for every item you list, you represent that:

  • You own it outright and have the right to sell it, or you are authorized by the owner to sell it.
  • It is not stolen, not subject to a lien or an insurance claim, and not reported lost.
  • The serial number you entered, if any, is the serial number on the item.
  • The condition grade you chose is honest against our published five-point scale, and every mark you declared is photographed.
  • The photographs are of the actual item, taken by you, and not copied from anywhere else.
  • The item is not counterfeit and does not infringe anyone's rights.
  • You are shipping exactly what is included in this listing and nothing else. No hazardous items are included, other than batteries you have already declared.
  • You agree that Film Gear Hub will buy shipping insurance for this shipment on your behalf.

The listing is yours, and so is responsibility for it. We verify who you are and we record your serial number when the item has one. We never see, touch or inspect the item. Every statement about its condition, its history, its faults and what is in the box is your representation alone, and you are responsible for it being complete and true. If you are unsure of a grade, grade down. If a fault might matter to a buyer, declare it and photograph it. Silence about a known fault is a misrepresentation.

We record the serial number of every item that has one, when the listing is filed and again at the point of sale, and we keep a record of the serials that have been listed and sold here. Where there is a serial on record, that is what lets a buyer establish that the item delivered is the item that was sold, and what a claim is decided against. Grip equipment, bags, cages and most other accessories rarely carry a manufacturer serial at all; for those, a claim is decided on the photographs and the seller’s own representations instead. We do not check serial numbers against any stolen-property database, our own or anyone else’s. Recording a serial is not a check, we do not represent it as one, and nothing about a listing appearing here is a warranty that an item is not stolen. We may still refuse, remove or hold any listing at our discretion, and we may report a suspected stolen item to law enforcement.

5

Offers and how a sale is formed

A listing is an invitation to treat, not an offer. A sale is formed when you complete checkout, at which point the item comes off the market.

Once a sale is formed the seller must ship, or make the item available for collection, within a reasonable time. A seller who repeatedly fails to complete sales may be suspended.

6

Prices, fees and tax

Sellers set their own prices. On a completed sale we charge the seller a fee of 8.5%, calculated on the item price and on nothing else. It is not charged on the shipping or on the sales tax, because neither of those is the seller’s money. There is no listing fee and no charge if an item never sells.

Buyers pay the item price, shipping, and any sales tax we are required to collect. Shipping is quoted before you pay. Local pickup is free. We charge sales tax in the states where we are required to, and we remit it; where we do not collect it, you may still owe use tax in your state.

Optional paid features, such as featuring a listing, are priced where you buy them and are separate from the seller fee. We may agree a different seller fee with a business seller in writing, and that agreement applies to that seller instead of the rate above.

We may change our fees on 30 days’ notice. Changes never apply to a sale already formed.

7

Payment, and what “held” means

When you buy, your card is charged and the money is held. The seller can see that it is held, which is what gets the item shipped, and cannot draw on it. Held funds are our funds in transit to the seller, not a deposit held for you.

Payment is released to the seller when you accept the item, or automatically 48 hours after delivery if you have not accepted it and have not opened a case. Opening a case before that window closes freezes the payment until the case is settled.

You complete an identity check before you can pay, on any order. It is the same check sellers pass: a government ID document and a live selfie, captured and held by Stripe Identity. We receive whether it passed, the name on the document and the date. We never see or store the document, and it is never shown to the seller. The check is asked once and applies to every order you place afterwards. Until it is complete the order is held for you and nothing is charged; if you decide not to complete it, tell us and we will cancel the order and release the item.

Orders at or above $6,000 settle on the platform on the same terms as any other order, but we do not accept a card for them: payment is by ACH bank transfer or a pay-over-time provider offered at checkout, to keep chargeback exposure off the largest orders on the site.

8

Shipping, insurance and risk of loss

We buy the shipping label, not the seller, and we buy the shipping insurance on the seller’s behalf, so that no shipment goes out uninsured or untracked. Every shipment is insured for the full sale price and requires a signature. Shipping insurance covers up to $10,000 a package, so an item listed at $9,999 or more is sold for local pickup only and is not shipped. A kit that ships in several boxes gets a label and a tracking number per box, and is only treated as delivered when the last box arrives.

Ship exactly what the listing includes, and nothing else. Nothing hazardous goes in the box other than batteries you declared when you listed the item. Whatever the package holds is what the insurance is bought for, and what a claim is decided on.

Risk of loss or damage in transit sits with us for the duration of the carriage, and because we buy the insurance on the seller’s behalf, we are the ones who make the claim. It passes to you on your acceptance of the item.

Packing is the seller’s job and the seller’s risk. You must pack every item to the standard shown on your order page, which follows our insurer’s guidelines: a rigid, plain box rather than a padded envelope; at least two inches of foam or air pillows between the item and every side, not paper, newspaper, clothing or loose cardboard; bodies, lenses and accessories wrapped separately and two inches apart, caps and covers fitted; two-inch plastic tape in an H across every seam, top and bottom; the label in a clear sleeve; a double-walled box with foam at the corners for anything over ten pounds; and no loose spare batteries. Photograph the packed box before you seal it.

If you are unsure, let the carrier pack it. FedEx and UPS both offer a packing service at their counters, and it costs a fraction of the item. Where the carrier packed the item themselves, the packaging is their work and a refusal on packing grounds is one we will take up with them rather than with you. Keep the receipt: it is the whole of your defense if a claim is ever argued.

Insurers and carriers refuse claims for inadequate packaging, and that refusal is theirs to make, not ours to overrule. Where a claim is refused on those grounds the loss is yours: we will not release the sale proceeds against a package that arrived broken because it was badly packed, we may set the loss off against that payment or any other balance we hold for you, and any shortfall is recoverable from you as a debt. Section 12 sets this out in full.

Carrier adjustments are charged back to you. If you ship an item in a different box or at a different weight than you declared, or otherwise ship it other than as declared, we adjust your payout by what that costs us. You tell us the weight of the packed item and the box it ships in, and we buy the label on those figures. If the carrier later bills us more because the package weighed more or measured bigger than you declared, because of how it was packed, or because the address had to be corrected, that extra charge is yours. Carriers usually send these weeks after delivery, so we normally take it off your next payout, and if it is more than that payout, the rest comes off the one after. We tell you by email when we record one, with the amount, the reason and the carrier’s reference, and we keep the carrier’s adjustment record as the evidence for it. If you think one is wrong, tell us and send what you have, such as a photo of the packed box on a scale, and we will take it up with the carrier.

9

Local pickup

Where a seller allows collection in person, we do not ship, nothing is insured in transit, and you and the seller arrange the handover directly. Each listing has a code verification the seller photographed with the item, and the buyer should ask to see it at the door. Meet somewhere sensible. We are not a party to the meeting.

The money stays held until the handover is confirmed. The seller gives the buyer a code in person, and the buyer confirms with it that they have the item. If neither of you confirms within a week, we look at the order ourselves and do not pay the seller automatically.

10

Inspecting what arrives

You have 48 hours from delivery to check the item against its listing and either accept it or open a case. If you do nothing, the payment releases automatically and your Not-As-Described rights under section 11 end.

To open a case, go to your account, find the item, and press Report a problem next to it. Wherever this document says you may open a case, that is how.

Accepting is not a formality. It pays the seller and ends those rights in the same action, and when you accept you confirm that:

  • The serial number on the item matches the one on the record, if it has one.
  • It is in the condition the listing described.
  • There is no damage that the listing did not disclose.

We record that confirmation against the order, with the serial we showed you at the time, if there was one. If any of those is not true, do not accept: open a case inside your window and nothing releases.

11

The Not-As-Described Guarantee

If the item you receive materially differs from the listing, open a case inside your window and nothing releases. Where we uphold the case, you return the item and we refund you in full, including the shipping you paid, to your original payment method. We pay the return shipping.

An item materially differs if:

  • The serial number does not match the listing.
  • It is a different model, or a different item entirely.
  • It has a functional fault the seller did not declare.
  • Its condition is materially worse than the grade claimed and the photographs shown.
  • Something the listing said was included is missing.

It does not cover:

  • Buyer's remorse, a better price found elsewhere, or a change of plan.
  • Wear consistent with the grade that was declared and photographed.
  • Damage you caused after delivery.
  • Items graded E and sold as-is for parts or repair, which are not represented as working.
  • Anything raised after the inspection window closed.

Returned items must go back in the condition they arrived, with everything that came with them. We decide cases on the listing, the photographs, the tracking and what both parties submit. Our decision is final as between us; it does not stop you pursuing the other member directly.

12

Seller responsibility, and what getting it wrong costs you

This section is the counterpart to the guarantee above. The protections a buyer gets here are funded, in the end, by the seller who caused the problem.

You warrant, on every sale, that the item is exactly what your listing said it was; that the grade you chose is honest against the published scale; that every fault, mark, repair and modification you knew of is declared and photographed; that everything the listing says is included is in the box; and that the item is packed to the standard in section 8.

Where you breach that warranty, you forfeit the following, and this is the whole of it:

  • Your claim to the money. Held funds for that order are not released to you, and funds already released are recoverable from you, by set-off against your other balances or as a debt.
  • Cover under the shipping insurance. The cover we buy on your behalf protects a package that was honestly described and properly packed. A claim arising from a misdescription, an undeclared fault, or packaging below the section 8 standard is void, and the insurer or carrier will refuse it in any event.
  • Your right to refuse the return. The buyer returns the item at our direction and we pay the return shipping, then recover that cost from you.
  • Our commission, which is not refunded, because the work of running the sale was done.

What you do not forfeit is anyone else's protection. A buyer’s rights under section 11 are never reduced by a seller’s breach. They exist precisely for that case. Nothing in this section is a defense we will raise against a buyer, and nothing a seller does or fails to do can void a buyer’s guarantee.

Repeated or deliberate misrepresentation, including grading dishonestly to clear stock, omitting a known fault, or shipping a different item from the one photographed, ends the account. Where we believe an item was knowingly sold as something it is not, we may report it to the payment network, to the carrier, and to law enforcement.

None of this limits any right a buyer has under consumer protection law, which cannot be waived by either of us.

13

Reviews and public history

Once an order has settled, the buyer may rate the seller from one to five stars. A rating is a number, with no comment. A seller’s completed sales, star rating and the number of claims opened against them are public.

You may not condition a rating on a payment, a refund or a favor. We do not remove a rating because it is unflattering to a seller or to us.

14

Your content

Your photographs and text stay yours. You grant us a worldwide, non-exclusive, royalty-free license to host, display, resize and distribute them for the purpose of operating and promoting the marketplace, including after the listing ends so that the record of a completed sale remains intact. You confirm you have the rights to grant this.

15

Things you must not do

  • Take a transaction off the platform after meeting through it, or ask another member to.
  • List anything you do not own, may not sell, or have misdescribed.
  • Create a second account after suspension, or use another person's identity.
  • Manipulate offers, reviews or prices, including bidding on your own listings.
  • Scrape the site, or use it to build a competing dataset.
  • Interfere with the service, probe it for vulnerabilities without permission, or work around any limit we set.

Off-platform circumvention is the one we enforce hardest, because it strips the buyer of every protection described here. We may charge the fees we would have earned, suspend the account, or both.

16

Chargebacks

If something is wrong with an order, open a case. It is faster than a chargeback, it is decided by someone who can see the listing, the photographs and the serial, and it does not put your account at risk.

A chargeback filed instead of that is a different thing. Where you charge back an order you accepted, an order we have already resolved in your favor, or an item you received and kept, we will close your account and we will recover the disputed amount, the chargeback fee and our costs of defending it from you as a debt. We defend those disputes with what this site records as a matter of course: the serial we logged, the possession photograph, the tracking, the signature taken on delivery, and the identity check completed on the account that placed the order, together with whether the name on the card matched the name on that ID.

This is not aimed at you if your card was used without your permission. That is a dispute you are entitled to bring and you are the victim of it. Tell your bank, and tell us at support@filmgearhub.com so we can stop the order and preserve what we hold. Nothing in this section costs you your account for reporting a card you did not use.

Where the evidence shows an item was delivered, kept and then charged back, we may report the matter to law enforcement and will cooperate with any investigation. We do not make that referral automatically or as a threat, and we do not make it on a dispute we have not looked at.

Section 20 governs how any dispute between us is resolved, and either of us may bring an individual claim in small claims court.

17

Suspension and closing your account

You may close your account at any time, subject to completing any open orders, by writing to support@filmgearhub.com. We may suspend or close an account that breaches these terms, that we reasonably believe is being used for fraud or to sell stolen goods, or where we are required to by law.

Closing an account does not erase its trading history. Completed sales, ratings and case outcomes are retained, disassociated from your contact details, as described in our privacy policy. A marketplace whose history can be deleted by the person it reflects is not a record of anything.

18

Disclaimers and the limit of what we owe you

Except for the Not-As-Described Guarantee in section 11 and anything else expressly promised here, the service is provided “as is” and we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non-infringement, to the fullest extent the law allows. We do not warrant that any listing is accurate, that any member is trustworthy, or that the service is uninterrupted.

To the fullest extent permitted by law, neither party is liable to the other for indirect, incidental, special, consequential or punitive damages, or for lost profits or lost data. Our total liability to you for any claim is limited to the greater of the amount you paid or received on the order the claim concerns, or $500. Nothing here limits liability for fraud, gross negligence, willful misconduct, or anything that cannot lawfully be limited. Some states do not allow these exclusions, so parts of this section may not apply to you.

Disputes between members about an item are between those members. You release us from claims arising out of another member’s conduct, beyond what section 11 provides.

Any claim you bring against us must be filed within one year of the event it arises from, or it is permanently barred, except where the law does not allow that limit. This does not shorten the Not-As-Described window in section 11, which is much shorter and is stated there.

19

If someone else sues us because of what you did

You will defend us, and cover what it costs us — damages, settlements and reasonable legal fees — where a third party brings a claim against us arising out of any of the following:

  • Something you listed or sold: that it was not yours to sell, was stolen, was counterfeit, infringed someone's rights, or was not what you described.
  • Anything you uploaded, wrote or sent through the service, including photographs you did not take.
  • Your breach of these terms, or of any law that applies to what you were doing here.
  • Tax you were required to collect, report or pay on a sale and did not.

This does not cover our own wrongdoing. Nothing here makes you responsible for a claim caused by our negligence, our breach of these terms, or anything we did that you had no part in. It does not apply to a dispute between you and another member about an item — that is what the guarantee in section 11 and the case process are for, and we do not charge our costs of running them to either side.

We will tell you promptly about any claim we expect you to cover, and we will not settle one in your name without asking you first. You may choose your own lawyer for it, and we may take part at our own expense.

20

Arbitration and class action waiver

Read this section. It affects how any dispute between you and us is decided.

You and we agree to try to resolve any dispute informally first. Write to support@filmgearhub.com describing the problem and what you want. If it is not resolved within 60 days, either of us may start arbitration.

Any dispute arising out of these terms or the service will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, before one arbitrator, in Williamson County, Texas or by video at your election. The Federal Arbitration Act governs this section. The arbitrator decides everything except the enforceability of the class action waiver, which is for a court.

You and we each waive the right to a jury trial and to participate in a class, collective or representative action. The arbitrator may not consolidate claims or preside over a class proceeding.

You may opt out. Send your name, your account email and a statement that you are opting out of arbitration to support@filmgearhub.com within 30 days of first accepting these terms. Opting out costs you nothing and changes nothing else about your account.

Either of us may bring an individual claim in small claims court instead. Nothing here prevents either of us from seeking an injunction to protect intellectual property.

21

Intellectual property and copyright complaints

The site, its design, text and software are ours. These terms grant you no license to them beyond using the service as intended.

If you believe something here infringes your copyright, send a notice under the Digital Millennium Copyright Act to Film Gear Hub, LLC, 5900 Balcones Drive, STE 100, Austin, TX 78731, telephone (512) 887-4968, or support@filmgearhub.com identifying the work, the material, your contact details, a statement of good faith belief, and a statement under penalty of perjury that you are authorized to act. We remove infringing material, notify the member, and accept counter-notices. Repeat infringers lose their accounts.

22

Changes to these terms

We may change these terms. For a material change we will give at least 30 days’ notice by email and on this page, and it will not apply to any order already placed. Continuing to use the service after a change takes effect means you accept it.

23

General

These terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. Subject to section 20, the courts of Williamson County, Texas have exclusive jurisdiction.

If a provision is unenforceable, the rest survives. Our not enforcing something is not a waiver of it. You may not assign these terms; we may assign them to a successor in a merger or sale of the business. These terms, the privacy policy and the guarantee described here are the entire agreement between us about the service.

Questions: support@filmgearhub.com or (512) 887-4968. Written notice reaches us at Film Gear Hub, LLC, 5900 Balcones Drive, STE 100, Austin, TX 78731. Effective 28 October 2026.
