Copyright

If something here is yours.

Members upload photographs and write descriptions on Film Gear Hub. If you believe something they posted infringes your copyright, this is how to tell us and what happens next.

1

Our designated agent

Send notices under the Digital Millennium Copyright Act to:

Film Gear Hub, LLC, 5900 Balcones Drive, STE 100, Austin, TX 78731, telephone (512) 887-4968, or support@filmgearhub.com.

Email is quickest (support@filmgearhub.com). Put “Copyright notice” in the subject so it reaches the right person.

2

What a notice has to contain

  • Your name, address, telephone number and email address.
  • A description of the copyrighted work you say has been infringed.
  • Where the material is on the site: the address (URL) of the listing, kit or page.
  • A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent or the law.
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner of the right, or authorized to act for the owner.
  • Your physical or electronic signature.

A notice missing these may not be acted on. Knowingly misrepresenting that something is infringing can make you liable for damages.

3

What we do

When a notice is complete we remove or disable access to the material, tell the member who posted it, and give them a copy of the notice. A removed listing is taken off sale until the matter is settled.

4

If you are the member

You can answer with a counter-notice if you believe the material was removed by mistake or misidentification. It has to give your name, address and telephone number, identify the material and where it was before it was removed, state under penalty of perjury that you have a good faith belief it was removed by mistake, and consent to the jurisdiction of the federal court for your address and to accept service from the person who sent the notice. Send it to the agent above. Unless the sender tells us within ten to fourteen business days that they have started a court action, we may restore the material.

5

Repeat infringers

A member who is the subject of repeated valid notices loses their account. Their sales history is kept as the law requires; their listings are not.
